BHA online sales platform for horses

  1. Baltic Horse Sales Limited Liability Company, registered in Riga, Latvia under company registration ID 40103356700, in case that this Company facilitates the Baltic Horse Auction and the Online Sales Platform Auction service, hereinafter referred to as BHS;
  2. BHS is providing a service for Sellers and Buyers to present for sales, bid and buy the horses / foals / embryos, by means of online bidding, hereinafter referred to as BHA Online Sales Platform.
  3. Participation in BHA Online Sales Platform for horses is voluntarily, and implies the explicit and unreserved knowledge and acceptance of these sales conditions.
  4. The Buyer must register via the BHA Online Sales Platform for horses’ website before submitting bids.
  5. The horses / foals / embryos are sold in the condition they are in, at the time of publishing on the BHA Online Sales Platform for horses.
  6. The seller accepts the terms and conditions (€ 100,- excl. VAT to be paid upon registration when selling the horse via the website) and confirms to have understood them by completing the registration form of the BHA Online Sales Platform for horses.
  7. After the Seller has confirmed the Bid offered by the Buyer, the Buyer will pay the final horse / foal / embryo price (including or excluding the VAT, depending on the Buyer status) + the BHS Auction commission of 10% + the commission VAT of 21%), the amount being calculated on the final highest bid offered and accepted by the Seller.
  8. The Seller gives the Bidder the opportunity, if desired, to view horses / foals offered for sale prior to a sale, by appointment via BHS only.
  9. The sale is effected according to Latvian law by acceptance of the offer by the Seller and after payment of the invoice amount via the BHS escrow account.
  10. Bids and payments are made in €.
  11. Buyer agrees to pay for the horse / foal / embryo if it is the highest bidder. It is not possible to withdraw a placed bid.
  12. The Seller has 8 hours to accept the offer or make a counter-offer. After these 8 hours, the offer will expire.
  13. An offer accepted by the Seller for a horse / foal / embryo will result in a binding agreement. The buyer undertakes to actually complete the purchase. By submitting a bid, the bidder undertakes to pay the invoice amount. The purchase price is calculated by multiplying the sales price with any applicable VAT and the Auction Commission + 21% VAT. The total becomes the invoice amount that is issued by BHS towards the Buyer.
  14. The purchase price is immediately due upon allocation of the horse / foal / embryo. As soon as the Seller has accepted the offer, the Buyer will receive an invoice from BHS with the amount to be paid.
  15. Any liability with regard to the sold horses / foals / embryos is transferred to the Buyer 5 days after acceptance of the offer. The legal agreement lies directly between the Buyer and the Seller, with due observance that vis-à-vis the Buyer, not the BHS, but the Seller is liable for any shortcoming that the animals may display after the sale.
  16. The ownership of the horses / foals / embryos transfers to the Buyer at the time of payment of the invoice amount as issued by the BHS.
  17. After the total invoice amount has been transferred to the BHS account, BHS will then share the Seller contact details with the buyer for arranging of the delivery of the horse/foal/ambryo. 
  18. Delivery will only take place in consultation between the Buyer and the Seller, directly. 
  19. Transport costs are at the expense of the Buyer and by a separate agreement between the Seller and the Buyer, with no involvement of BHS or BHA Online Sales Platform whatsoever.
  20. In principle, a foal is delivered after the foal has reached the age of 5 months. The Seller is obliged to leave a sold foal with the mother up to the age of 5 months without the Buyer being obliged to pay any compensation for this. Until the moment of actual delivery to the Buyer, the Foal remains at the expense and risk of the Seller.
  21. When a foal is delivered in consultation that is younger than 5 months, the risk immediately transfers to the Buyer upon delivery.
  22. Foals are at least good halter tame at delivery.
  23. If the horse / foal / embryo is sold abroad, it must be accompanied by export documents approved by a licensed veterinarian. The BHS will provide these export documents. The costs are billed to the Buyer.
  24. Neither the Seller nor the Buyer can derive any rights from the fact that the BHS has selected the horses / foals / embryos to be published on the BHA Online Sales Platform and, if desired, they have been subjected to a veterinary examination.
  25. The information given about the horses / foals / embryos offered for sale is only intended to give an impression of the qualities of the horses / foals / embryos, without pretending to be complete and without making any guarantees. When describing horses / foals / embryos on its website, BHS and the BHA Online Sales Platformdepends on the information provided by a seller or third parties. BHS and BHA Online Sales Platform are not liable for (printing) errors and / or mistakes on its website and in the online sales catalog.
  26. In the event of a dispute between parties, the court of Latvia has exclusive jurisdiction. Any dispute arising from this BHA Online Sales Platform and its consequences is exclusively governed by Latvian law.
